Employee Leave Entitlements in Zimbabwe

The Labour Act [Chapter 28:01] establishes minimum leave entitlements for all employees in Zimbabwe. These are statutory minimums — NEC agreements or individual employment contracts may provide more generous terms, but never less than what the Act prescribes.

Annual Leave (Vacation Leave)

Every employee is entitled to 1 day of annual leave per month worked, which totals 12 working days per year after completing one year of continuous service.

Note: Some NEC agreements provide for more than 12 days’ annual leave, particularly in sectors like mining and banking. Always check your applicable NEC agreement.

Sick Leave

Employees are entitled to generous sick leave provisions under the Labour Act:

This entitlement operates on a 2-year rolling cycle. A medical certificate is required for absences exceeding 2 consecutive working days. The employer may require the employee to be examined by a company-nominated doctor.

Key rules for sick leave:

  • The 2-year cycle resets after the full 180-day entitlement is exhausted
  • Sick leave cannot be used as annual leave or vice versa
  • An employee who is frequently absent due to illness may be referred for a medical assessment
  • If the employee is incapacitated beyond 180 days, the employer may terminate on medical grounds after following proper procedures

Maternity Leave

Female employees are entitled to 98 days (approximately 3 months) of maternity leave. This is one of the most important protections under the Labour Act.

Important: Dismissing an employee because of pregnancy or during maternity leave is automatically unfair dismissal under the Labour Act. This applies even if the employer was unaware of the pregnancy at the time of dismissal.

Paternity Leave

Since 2025, male employees in Zimbabwe are entitled to 10 days of paternity leave following the birth of their child. Key details:

  • Duration: 10 working days
  • Pay: Full salary paid by the employer
  • Timing: Must be taken within a reasonable period around the birth
  • Documentation: Employer may request proof of birth

Public Holidays

Zimbabwe has 12 gazetted public holidays per year. Employees are entitled to a paid day off on each public holiday. If required to work on a public holiday, the employee must be compensated at double the normal daily rate.

If a public holiday falls on a Sunday, the following Monday is observed as the holiday.

Other Types of Leave

Bereavement Leave

Not specifically mandated by the Labour Act, but most NEC agreements and company policies provide 2 to 5 days of paid leave for the death of a close family member (spouse, child, parent, sibling).

Study Leave

Some NEC agreements provide for paid or unpaid study leave for employees pursuing approved qualifications. The duration and conditions vary by sector.

Compassionate Leave

Employers may grant compassionate leave at their discretion for personal emergencies. This is typically governed by company policy rather than statute.

Leave for Union Activities

Employees who are trade union representatives are entitled to reasonable time off (with pay) to attend to union duties, including meetings, training, and collective bargaining sessions.
